Premium Setup Terms of Use
Occasionally we offer premium iRacing setups for sale. You are not purchasing the setup file from OSRacing.net. You are compensating the website operator and/or the setup builder for time and labor. There are no refunds. No warranty of any kind is made for any iRacing setup file hosted on this website.
Any setup file obtained from this website is provided as is, where is, as an accommodation, and without warranty of any kind. In no event shall OSRacing.net or Jeff Kendrick be liable for damages of any kind incurred by you as a result of the download and use of the iRacing setup files hosted on this website.
To the fullest extent permitted by applicable law, in no event will this Website operator, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to any person for (a): any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Website operator has been advised as to the possibility of such damages or could have foreseen such damages. There is no (zero) aggregate liability of the Website operator and its affiliates, officers, employees, agents, suppliers and licensors, relating to the services or digital products provided.
Free Setup Terms of Use
This Website, OSRacing.net, provides iRacing setups to the public. OSRacing.net gathers iRacing setups from various other websites, and setups are shared with me. All of the setups that OSRacing.net provides are either:
- publicly available elsewhere, or
- have been shared with me within the iRacing simulation, by email, through Discord or some other medium, or
- are made by me.
All setup builders should be aware of the fact that iRacing owns the software. If you modify (build) a setup, you don’t own it and you have no claim to it.
If you see one of your setups on this website you can politely ask me to remove it. Although I am under no obligation to remove any iRacing setup, I will remove setups upon polite request, provided that I believe beyond any reasonable doubt that you are the setup builder for the setup concerned. If I am not convinced beyond a reasonable doubt that you are the setup builder for the setup concerned, I will ask you to prove your identity by emailing me a picture of you holding a government issued picture ID. The picture must clearly show your actual face, your face depicted on the ID, and your full name on the ID. All other information can be redacted. The only remove requests that will be considered must be made by the individual who is credited with building the setup. If the setup is credited to a group, team, or other organization, only a verified representative of the group, team, or organization may request removal.
All setups that are provided for download on OSRacing.net are for the sole purpose of normal use in the iRacing simulation. Normal use includes using the setup for practice, racing, time trial, or other normal iRacing activities, and modifying the setup to your personal preference. Any other purpose is a violation of these Terms. If the administrator discovers that any individual has downloaded an iRacing setup for any purpose that is not defined here, that individual will be permanently blocked from accessing the OSRacing.net website.
